Register a Trade Mark
To register a trademark in Singapore, you need to file an application with the Intellectual Property Office of Singapore (IPOS). You can do this online via the IPOS Digital Hub or in person at the IPOS office.
The application form, Form TM4, must include the following information:
Your name and address
A clear graphical representation of your trademark
A list of goods and/or services in relation to which you wish to register your trademark
A declaration of your use of or intention to use the mark
The relevant application fee
The application fee depends on the number of classes of goods and/or services that you are applying to register your trademark for. You can find the current fees on the IPOS website.
Once you have submitted your application, IPOS will examine it to see if it meets all of the requirements. If it does, your application will be published in the Trade Marks Journal. This gives other people the opportunity to object to your application if they believe that it is infringing on their existing trademarks.
If there are no objections, your trademark will be registered and you will be granted a certificate of registration. Your trademark will be protected for a period of 10 years, and you can renew your registration for subsequent periods of 10 years.
Here are some additional tips for registering a trademark in Singapore:
Conduct a trademark search before you file your application to make sure that your trademark is not already registered by someone else. You can do this on the IPOS website.
Be specific when listing the goods and/or services that you wish to register your trademark for. The more specific you are, the more likely it is that your application will be approved.
If you are not sure how to fill out the application form, you can seek professional advice from Bestar.
Once your trademark is registered, you have the exclusive right to use it in Singapore in relation to the goods and/or services that you have registered it for. You can also take legal action against anyone who infringes on your trademark rights.
