Process of Becoming an IPC and the Benefits of Being One

In Singapore, an Institution of a Public Character (IPC) is a special status granted to registered charities or exempt charities. This status allows them to issue tax-deductible receipts for qualifying donations, making it highly attractive for donors.

Process of Becoming an IPC in Singapore

Becoming an IPC involves several steps and adherence to specific criteria, building upon the initial requirement of being a registered charity.

1. Be a Registered Charity or Exempt Charity: The fundamental prerequisite is that your organization must first be a registered charity in Singapore, or an exempt charity. To become a registered charity, your organization generally needs to:

  • Have exclusively charitable purposes (e.g., relief of poverty, advancement of education, advancement of religion, or other purposes beneficial to the community like promotion of health, arts, heritage, environment, etc.).

  • Be set up as a Company Limited by Guarantee (CLG), a Society, or a Charitable Trust.

  • Have at least 3 governing board members, with at least two being Singaporeans or Permanent Residents.

  • Ensure its purposes are wholly or substantially beneficial to the community in Singapore.

2. Meet IPC Eligibility Criteria: Once a charity, to qualify for IPC status, it must meet additional criteria, including:

  • Exclusive benefit to the local community: The charity's activities must primarily serve the needs of the community in Singapore as a whole, and generally not be confined to sectional interests or groups based on race, belief, or religion. (Waivers may be granted in exceptional cases by the Minister, such as for the four self-help groups).

  • Approved Governing Instruments: The charity's governing instruments must be approved by its Sector Administrator.

  • Meeting Objectives: Activities must align with the IPC's objectives under its governing instruments and the objectives of its Sector Administrator.

  • Governing Board Independence: The governing board must fulfill independence requirements stipulated in the Charities (Institutions of a Public Character) Regulations.

  • Singapore Citizen Majority on Board: At least half of the governing board members must be Singapore Citizens.

  • Accountability for Donations: Governing board members must be accountable for the management of donations received.

  • Approved Auditor: Its auditor must be approved by the Sector Administrator.

3. Application Process:

  • A registered charity can submit an "Application for Approval as an IPC" via the Charity Portal.

  • Existing IPCs applying for an extension of their status would submit an "Application for Extension as an IPC."

  • The application typically requires relevant documents, including the organization's governing instrument, financial statements (if applicable), and a 2-year activities and fund disbursement plan.

  • The processing time for an IPC application is generally around two months.

4. Ongoing Compliance: Upon approval, IPCs are subject to higher standards of regulatory compliance and governance. This includes submitting annual reports detailing the use of donation money and proposed future plans.

Benefits of Being an IPC in Singapore

The IPC status offers significant advantages, primarily aimed at encouraging donations and enhancing public trust:

1. Tax Deductible Donations:

  • This is the most significant benefit. IPCs are authorized to issue tax-deductible receipts for qualifying donations received.

  • Donors (both individuals and corporations) can claim a 250% tax deduction on qualifying cash donations made to approved IPCs. This means for every $1 donated, $2.50 is deducted from their taxable income.

  • Certain non-cash donations, such as public shares listed on SGX, units in unit trusts, land or buildings, and even donations to name IPC facilities or programs, can also be tax-deductible.

2. Increased Funding and Donations:

  • The tax deduction incentive makes donating to an IPC much more attractive, often leading to increased donations from individuals, corporations, and foundations.

  • This enhanced ability to attract funds directly supports the IPC's charitable work and expands its reach and impact.

3. Enhanced Public Trust and Credibility:

  • Being an IPC signifies that the organization meets stringent governance and transparency standards set by the Commissioner of Charities.

  • This status instills greater public confidence and trust in the organization, assuring donors that their contributions are managed responsibly and used for legitimate charitable purposes.

4. Eligibility for Matching Funds (for specific sectors):

  • Some IPCs, particularly in the arts and heritage sector, can apply for matching funds like the Cultural Matching Fund (CMF). This fund provides a dollar-for-dollar match for eligible donations, further boosting the organization's financial capacity.

5. Recognition and Visibility:

  • The IPC status elevates the organization's profile within the charity sector and the wider community, making it more recognizable and reputable.

In essence, becoming an IPC in Singapore is a robust process that ensures charitable organizations operate with high standards of governance and transparency, in return for the crucial benefit of enabling tax deductions for their donors, thereby fostering a culture of giving in the nation.
